NON – DISPARAGEMENT AND REPUTATION PROTECTION POLICY

This Non-Disparagement and Reputation Protection Policy forms part of the contractual framework governing all services provided by CAE Business Solutions LTD. It should be read in conjunction with our Terms and Conditions and Complaints Handling Policy. In the event of inconsistency, the Terms and Conditions shall prevail.
1. Professional Conduct Obligation
All clients agree to conduct themselves in a professional, lawful, and good-faith manner during and after the provision of services.
2. Prohibited Conduct
Clients shall not publish, communicate, or cause to be published any statement, allegation, or commentary that is:

Misleading
-
Reckless as to its truth

Defamatory
-
Malicious
-
Designed to cause reputational harm
This includes, but is not limited to:

Online reviews
-
Social media posts
-
Blog publications
-
Public forums
-
Communications with competitors or third parties
Nothing in this clause prevents lawful, factual, and good-faith criticism.
3. Mandatory Dispute Resolution Prior to Public Commentary
Where a concern arises, clients are contractually required to utilise our Complaints Handling Policy and dispute resolution procedures before publishing negative public commentary.
Failure to do so may be treated as a material breach of contract.
4. Defamation and Reputational Harm
Where statements are demonstrably false, malicious, or published without reasonable verification, CAE Business Solutions LTD reserves the absolute right to pursue all available legal remedies under the laws of England and Wales, including but not limited to:

Formal legal notice and demand for removal

Injunctive relief

Damages for reputational and commercial loss

Recovery of legal costs
We take reputational harm seriously and will act decisively where necessary.
5. Cost Recovery
Where reputational harm arises from false or malicious statements, we reserve the right to recover reasonable legal, administrative, and enforcement costs incurred in protecting our business interests.
6. Continuing Obligation
This clause survives termination of any service agreement and continues to apply indefinitely.
7. Balance of Rights
This policy is intended to protect legitimate business reputation while respecting lawful freedom of expression. It shall be interpreted strictly in accordance with applicable UK law.
